Article 1 · Purpose
These Terms of Use set out the conditions of use of the Caves Explorer SaaS solution, published by APROGSYS SAS. Full acceptance of these terms is required to access and use the service.
Article 2 · Definitions
- Customer: legal entity or individual who has taken out a subscription
- User: individual authorised by the Customer to use the service
- Service: the Caves Explorer SaaS solution accessible online
- Data: information entered and stored by the Customer
Article 3 · Access to the service
3.1 Trial period
The 1st month of subscription is free across all plans, with no credit card required at signup.
3.2 Subscription
The Customer subscribes to one of the three available plans (Solo, Estate, Signature) according to the pricing published on /tarifs. The Customer agrees to provide accurate information at signup.
3.3 Credentials
The Customer is solely responsible for the confidentiality of their login credentials and for any use made of their account.
Article 4 · Use of the service
4.1 Compliant use
The following are strictly prohibited:
- Any fraudulent or abusive use of the service
- Any attempt at unauthorised access or intrusion
- Hosting illegal content or content contrary to public decency
- Reselling or redistributing the service without written authorisation
4.2 Number of users
The number of users per establishment depends on the plan: 1 user for Solo, 5 roles for Estate, unlimited users for Signature.
Article 5 · Customer data
5.1 Ownership
The Customer remains the owner of all their data.
5.2 Backup
Automatic daily backups are performed on OVH infrastructure in France. The Customer can export their data at any time in Excel format via the service interface.
5.3 Security
Technical measures in place: HTTPS encryption on all communications, multi-tenant architecture with strict isolation between customers, secure authentication, action logging, regular updates.
Article 6 · Pricing and payment
6.1 Pricing
Prices are quoted in euros excluding VAT (ex. VAT); the applicable VAT is invoiced in addition. The full pricing is available at /tarifs. APROGSYS reserves the right to amend its prices with 30 days' notice by email.
6.2 Payment terms
Invoicing is monthly or annual depending on the subscribed plan, by bank transfer or SEPA direct debit.
6.3 Late payment
In the event of non-payment, APROGSYS may suspend access to the service after a formal notice that remains unanswered for 15 days.
Article 7 · Term and termination
7.1 Term
The minimum commitment varies depending on the plan: 12 months for Solo, 24 months for Estate and Signature. The contract renews automatically by tacit agreement at the end of the initial period.
7.2 Termination by the Customer
The Customer may terminate at any time at the end of the commitment period, by registered letter or by email, with 30 days' notice. No prorated refund is granted.
7.3 Termination by APROGSYS
APROGSYS may terminate the contract in the event of serious breach by the Customer, after a formal notice that remains unanswered for 15 days.
7.4 Consequences of termination
The Customer has 30 days after termination to export all their data. Beyond this period, data will be permanently deleted from APROGSYS infrastructure.
Article 8 · Liability and warranties
8.1 Availability
APROGSYS commits to a 99.9% availability rate on an annual basis, excluding scheduled maintenance windows.
8.2 Maintenance
Maintenance operations are preferably carried out outside business hours, with prior notification to customers.
8.3 Limitation of liability
APROGSYS cannot be held liable for:
- Indirect damages (loss of revenue, customers)
- Inappropriate use of the service by the Customer
- Force majeure events
- Data loss due to misuse by the Customer
Article 9 · Technical support
Technical support is included in all subscriptions according to the following terms:
- Solo: email support within 48 hours
- Estate: priority support within 24 hours
- Signature: dedicated support within 4 hours

Article 10 · Amendments to the Terms
APROGSYS reserves the right to amend these Terms at any time. Any amendment is notified to customers by email with 30 days' notice. Continued use of the service after this period constitutes acceptance of the new terms.
Article 11 · Applicable law and jurisdiction
These Terms are governed by French law. In the event of a dispute and failing an amicable resolution, the competent courts of APROGSYS's registered office (Besançon) shall have sole jurisdiction.
